Bankruptcy and Medical Debt in Georgia

Medical debt is one of the most common reasons people consider filing for bankruptcy. A single hospital stay or unexpected surgery can leave a family with thousands of dollars in bills. The healthcare industry can be just as aggressive as other creditors in seeking payment. Hospitals frequently outsource unpaid accounts to third-party collectors, who may add interest, late fees and legal costs. Some medical groups file lawsuits quickly, especially in metro areas like Atlanta, Savannah and Augusta. Once a judgment is entered, collectors can pursue wage garnishment or bank levies.

Bankruptcy may be the best avenue of relief from heavy medical debt. The moment you file, an automatic stay goes into effect, which immediately stops all collection activity — phone calls, letters, lawsuits, garnishments and even scheduled court hearings — giving you space to breathe.

Medical bills are considered unsecured debt, similar to credit-card or personal-loan balances. That means they do not receive special priority in bankruptcy, nor is there collateral to repossess. However, these debts are treated differently depending on whether you file a Chapter 7 or a Chapter13.

In Chapter 7, medical debt is generally dischargeable. Because it is unsecured and not tied to any property, it is wiped out at the end of the case, whether the debt came from a hospital, urgent-care clinic, ambulance service or specialist. Chapter 7 also eliminates judgments related to medical debt, which stops future garnishment attempts.

In Chapter 13, medical debt is included in a repayment plan along with other unsecured debt. You make one monthly payment for three or five years and medical creditors receive the portion allocated to them under the plan. At the end of the case, any remaining medical debt is discharged. Chapter 13 is often the better option for Georgians who need to protect assets, catch up on mortgage arrears or manage tax debt while dealing with ongoing medical expenses.

Another important issue is how insurance disputes affect medical debt. If your insurer denies a claim in whole or in part, the remaining balance becomes your responsibility. Bankruptcy can discharge that balance, but it does not force the insurer to pay out more in benefits. Still, filing bankruptcy often encourages providers to stop fighting over old claims and move forward.

Another concern involves medical debt incurred for a child or spouse. In Georgia, the person who signed the treatment agreement is usually responsible, but bankruptcy can discharge that liability regardless of who received the care. This is especially helpful for parents facing pediatric-care bills or adults dealing with a spouse’s or parent’s unexpected medical emergency.

Medical debt is not a sign of financial mismanagement. It’s the result of unpredictable health events. A skilled bankruptcy attorney can advise you on the best way to deal with these expenses and to preserve your financial stability.
