What Assets Can You Keep When Filing Bankruptcy in Georgia?

When people think about declaring bankruptcy, they might worry they’ll lose everything to creditors. In reality, there are Georgia laws that exempt much of the property you rely on every day: your home, your car, your household items and your retirement savings. For most Georgians filing a Chapter 7 bankruptcy, these exemptions cover all or nearly all personal belongings.

Georgia’s homestead exemption is one of the most important protections. As of 2026, you can shield $50,000 of equity in your home if you are single or $100,000 if you’re married and filing jointly. This means that if your home’s equity falls within those limits, the trustee cannot sell it. For many homeowners, this exemption alone removes the prospect of losing their house during bankruptcy.

Vehicles also receive strong protection. Georgia allows you to exempt up to $5,000 of equity in one car. If your vehicle is worth about what you owe, it’s usually fully protected. If you have more equity than the exemption covers, you can often use Georgia’s wildcard exemption to protect the rest.

Household items are treated generously as well. Georgia exempts up to $5,000 total in household goods, with a limit of $600 per item. Clothing is fully protected and you can exempt up to $500 in jewelry. These limits cover the vast majority of everyday belongings and trustees rarely pursue household items unless they are unusually valuable.

The wildcard exemption gives you even more flexibility. You can protect $1,200 of any property, plus up to $10,000 of unused homestead exemption. This is helpful if you have extra equity in a vehicle, money in a bank account or personal items that exceed category limits. 

Georgia also fully protects essential income and long-term savings. Social Security, unemployment benefits, workers’ compensation and most retirement accounts — including 401(k)s and IRAs — are completely exempt. This ensures that a bankruptcy won’t jeopardize your future financial stability.

If you receive child support or alimony, those payments are exempt to the extent needed for support.
